General Terms and Conditions of Use

Dear member, dear guest,

welcome to BODYART. We rely on your help to ensure that our studio is always spotless. We do our best to ensure order and hygiene in the BODYART studio every day and are delighted to have you with us.

By participating in our courses and using the premises, you accept the following General Terms and Conditions of Use (GTC). We reserve the right to adapt our services and our GTC. The currently published GTC are authoritative in each case. We thank you for your understanding and wish you a good workout in the courses and relaxing moments!

General terms of use

WHOLE CLUB
We ask you to observe the rules and follow the instructions of the INDIGO/BODYART team. Please wear your street shoes only to the checkroom, do not use cell phones in the course room and leave the club in the evening punctually before the official closing time. Smoking is prohibited throughout the club.

CHECK-IN
Check-in takes place at the reception desk during each course visit.

FOOD AND BEVERAGES
We ask you to consume any food only in our lounge. In addition, only drinks with a cap are permitted in the entire studio.

CLOTHING
The course room may only be used in appropriate sports clothing (this includes in particular clean and suitable sports shoes) and care must be taken to ensure that feet are clean during barefoot training.

WORKOUTS
The number of participants in the courses is limited for quality reasons. Registration via the booking program is mandatory in order to participate in the courses.

WARDROBES
The large lockers are only intended for daily use and no unwashed clothes or food are to be stored in them. Please lock your wardrobe with your personal combination lock and clear it out again after each visit. We reserve the right to open the large lockers with prior written notice. Any items found inside will be stored in a safe place at the Club.

SAUNA, STEAM BATH & SHOWERS
Saunas and steam baths may only be used freshly showered. Shaving or other inappropriate behavior in the saunas, steam baths or showers is not permitted. The use of saunas and steam baths under the influence of alcohol or coagulation inhibitors, antihistamines, beta blockers, narcotics and tranquilizers is not permitted. Persons with diabetes, heart disease, high or low blood pressure or other illnesses should first consult a doctor and have it clarified that visiting our programs does not pose a risk to their own health.

QUIET ROOM
The relaxation room is a place to relax. Therefore, please refrain from loud conversations.

FOUND OBJECTS
We keep found objects at INDIGO/BODYART for a maximum of 2 months, after which they are given to charitable institutions.

LIABILITY
You use the BODYART facilities and services at your own risk. We therefore recommend that you undergo a sports medical examination before you start training. Training under the influence of alcohol or drugs is dangerous. We are authorized to refuse entry to members and guests who have consumed alcohol or drugs or to expel them from the premises of the BODYART studio. Entrance fees already paid will not be refunded. We do not guarantee the performance or results of the training. The operation of the studio may be temporarily suspended due to circumstances beyond our control. We also decline all liability in this respect. Any claims for damages against the operators of BODYART STUDIO are excluded to the extent permitted by law.

General Terms and Conditions

  1. The minimum age for members and guests is 18 years.
  2. Memberships, drop-ins and passes include: Use of the sauna, steam room, relaxation room, changing rooms, showers, lounge; attendance of scheduled group courses; one free shower towel per visit, free care products. Certain offers can also be used free of charge as part of trial sessions.
  3. The membership card entitles the holder to visit and use the BODYART facilities. The membership card is personal, non-transferable and cannot be changed.
  4. The minimum term of annual membership is 12 months. The annual membership is automatically renewed for exactly 12 months at the then current conditions if it is not terminated by registered letter 30 days before the end of the contract period. Shorter memberships, drop-ins, 10-pack passes and other subscriptions can also be offered.
  5. Premature termination of the contract is generally not permitted and will not trigger a corresponding refund. However, BODYART STUDIO reserves the right to offer solutions in cases of hardship, although there is no entitlement to this. Cases of hardship may be considered on a case-by-case basis: Prolonged illness or accident, definitive change of both place of residence and place of work (further than 30 km from BODYART STUDIO). The membership contract concluded online must be submitted together with a written request for reimbursement and the necessary confirmations, e.g. medical certificate, employer confirmation, proof of residence. The remainder of the annual membership will be refunded on a pro rata basis, provided that the available facts and the required documents are correct and there is a genuine case of hardship.
  6. If there is a valid reason (illness, pregnancy, accident, business trip abroad, military service, language course), membership can be interrupted for a period of at least 1 month up to a maximum of 9 months. Vacations do not count as a reason for an interruption. The time credit will be credited to the existing membership without any gaps. The interruption must be submitted to our reception desk before the absence, together with a corresponding confirmation/certificate. A retroactive interruption is only possible in the event of illness/accident. This must be applied for in the first month after the medically certified inability to train has ceased. Applications submitted at a later date will no longer be considered.
  7. Non-use of the services of the BODYART Studio does not entitle the member to a reduction or refund of the membership fee.
  8. Members and guests undertake to follow the instructions of the INDIGO FITNESS Club and BODYART Studio staff at all times and to strictly adhere to the terms of use.
  9. BODYART Studio and its staff are not liable for any damage resulting from an accident, injury or illness. Members and guests use the premises and services of BODYART Studio at their own risk. Furthermore, BODYART Studio is not liable for the loss of effects, valuables, money, clothing, etc. Any liability for deposited items is also excluded. Members and guests are responsible for taking out insurance.
  10. The BODYART Studio is open daily during operating hours, with the exception of various public holidays and with the exception of revisions, cleaning, renovations, etc. Members are not entitled to a refund or an extension of their annual membership due to other closures that are necessary for operations or ordered by the authorities (e.g. a pandemic such as COVID-19).
  11. Any credits expire at the end of the contract term and are neither transferred to a new contract nor paid out.
  12. The member expressly acknowledges that changes to the terms and conditions of use and the Club Guide are reserved and that these will be brought to his/her attention in an appropriate form. The member cannot derive any rights from a change to the terms of use. The current Terms and Conditions of Use and Business shall always apply.
  13. The BODYART Studio may change its offer and operating hours at any time. The member is not entitled to a refund in the event of a reduction in the offer or operating hours.
  14. Each member is aware that the courses may be recorded for live streaming and on-demand offers and streamed on the Internet directly or with a time delay, and expressly agrees to the distribution of these recordings for an unlimited period of time and place, and waives the right to demand the removal of these recordings. The same applies to the use of photos and videos for advertising materials (physical and online). If a member expressly does not agree to this, they must inform the course management in advance.
  15. Filming and/or photography during a BODYART Studio event or BODYART Studio course by members or guests is prohibited. Failure to comply with this regulation or other terms and conditions of use and business may result in exclusion from the event or course in question or termination of the subscription, whereby the participation fees shall continue to be owed, or a refund of payments already made shall be excluded in this case.
  16. BODYART Studio reserves the right to cancel courses due to insufficient numbers of participants, even at short notice. In this case, members will be given the opportunity to rebook for an alternative event free of charge or to reclaim the event fee. Travel and/or accommodation costs will not be reimbursed. We reserve the right to make changes to the schedule and also to relocate the event to another venue (within the announced metropolitan area).
  17. Vouchers are valid for a maximum of one year from the date of payment.
  18. The rights and obligations arising from this contract may be transferred by the BODYART Studio to a legal successor. The relocation of the BODYART Studio within the city limits does not entitle the customer to terminate the contract prematurely.
  19. The contract between BODYART Studio and the member is concluded in writing when the purchase is made. Any amendments or termination must be made in writing.
  20. By concluding the contract, the member confirms that they have completed the registration form truthfully. Furthermore, the member confirms that they have carefully read and taken note of the provisions of the contract and the currently valid terms and conditions of use and business of BODYART Studio and the INDIGO Club Guide, and that they will abide by them accordingly.
  21. Subscriptions are taken out online via our website and / or via external booking platforms. We reserve the right to stipulate further terms of use for the livestreams, which must be accepted by the member when using the corresponding offers. We offer the option of withdrawing from the contract within 14 days of booking.
  22. The place of jurisdiction is the city of Zurich. Swiss law shall apply, excluding the conflict of laws rules of private international law.
